1. Scope of these terms

These Terms and Conditions apply to enquiries and service arrangements concerning the careful assessment and opening of old locks, safes, chests, antique furniture and closed storage presented through Brassward Heritage Access. The business details used for the service are Chelmsford Master Locksmiths, Eckersley Road,Industrial Est, Victoria Road, Chelmsford, Essex, with enquiries at [email protected].

A website enquiry is a request for assessment, not automatic acceptance of a job. A service arrangement is formed only when the scope, access requirements and any applicable charges are agreed between the client and the business. If the written scope or quotation states additional job-specific conditions, those conditions form part of the arrangement to the extent they are consistent with applicable law.

2. Preliminary photo assessment

Photographs and descriptions are used to form an initial view of the visible mechanism, condition and surrounding material. A preliminary view cannot reveal every internal component, previous repair, hidden obstruction, seized bolt, structural issue or safety concern. The final opening method can therefore change after physical inspection.

Clients should provide clear, current photographs and accurate information about the object, location, known history, previous opening attempts and access conditions. Material changes between the photographs and the on-site condition should be disclosed before work begins.

3. Client authority and lawful access

The client must have a lawful right to request the assessment and opening work. The business may ask for evidence of ownership, estate authority, authorisation from an owner, tenancy or occupancy rights, restoration instructions, or another reasonable basis for control of the property or container. The type of evidence needed depends on the circumstances.

If authority is unclear, inconsistent or disputed, the business may delay or refuse the service until the issue is resolved. The client is responsible for the accuracy of representations made about ownership and authority and for obtaining any consent required from co-owners, landlords, estate representatives or other interested parties.

4. Inspection, preservation and method

The service is preservation-led, but no method can guarantee that an old mechanism or surrounding finish will remain entirely unchanged. Corrosion, fatigue, previous drilling, improvised repairs, failed components, trapped bolts, brittle timber, worn keys, masonry conditions and unknown internal alterations can require intervention that is not visible from photographs.

Before work proceeds, the specialist may explain the intended method, known risks and likely effect on the lock, fittings or surrounding material. If conditions materially differ from the original assessment, the work can be paused so the revised scope can be discussed. A request for minimal damage does not require the specialist to continue with a method that has become unsafe, ineffective or disproportionately destructive.

5. Contents and surrounding property

The client should tell the specialist if fragile papers, photographs, textiles, glass, valuables, hazardous materials or other sensitive contents may be present. This information can affect tool choice, dust control, support of the door and the way the item is positioned during opening. The client remains responsible for decisions about the handling, ownership, valuation or legal status of items found after access is achieved.

Where a safe or container is built into a wall, floor, cabinet or other structure, the surrounding construction may limit access and preservation options. Work outside the agreed lock-opening scope, including building repair, restoration, transport or valuation, is not included unless expressly agreed.

6. Pricing and payment

No universal fixed price is represented on this website because the mechanism, condition, access, preservation objective and likely labour can differ materially between jobs. A preliminary assessment may be used to identify what further information is required and whether an on-site inspection is appropriate. Where charges apply, the client should be told the basis of the charge before the relevant work is confirmed, where reasonably practicable.

If unexpected conditions require a material change to the agreed scope or cost, the specialist should pause when reasonably possible and seek further approval before continuing. Payment timing and methods may be stated in the quotation or service confirmation. Nothing in these terms limits a consumer right that cannot lawfully be excluded.

7. Cancellations and changes

If a client needs to change or cancel an arranged visit, notice should be given as early as reasonably possible. Any cancellation consequence depends on the terms communicated for that specific booking, costs already reasonably incurred and applicable consumer law. The business may also need to reschedule where access is unsafe, authority remains unresolved, weather or travel conditions prevent attendance, or specialist equipment is unavailable.

Where the business cannot perform an agreed service, the parties should first consider rescheduling or another reasonable solution. Any right to cancel, obtain a refund or seek another remedy remains subject to applicable law and the circumstances of the service arrangement.

8. Australian Consumer Law rights

Where the Australian Consumer Law applies, statutory consumer guarantees cannot be excluded, restricted or modified by these terms. Services must be provided with due care and skill, be reasonably fit for a disclosed purpose in circumstances where that guarantee applies, and be supplied within a reasonable time where no time is fixed. Remedies can apply where a service fails to meet a consumer guarantee.

Nothing in these Terms and Conditions is intended to remove or reduce rights or remedies that cannot lawfully be excluded. Any limitation stated elsewhere in these terms operates only to the extent permitted by law.

9. Liability and client responsibilities

To the extent permitted by law, responsibility is limited to loss or damage that is a reasonably foreseeable consequence of a failure to perform the agreed service with the required care. The business is not responsible for loss caused by inaccurate client information, undisclosed hazards, unauthorised instructions, pre-existing defects, hidden damage or interference by another person, except to the extent applicable law provides otherwise.

The client is responsible for providing safe and reasonable access to the item and for disclosing known hazards or restrictions. The specialist may refuse to enter or continue in a location considered unsafe or inappropriate for the work. This does not affect rights that arise from the business’s own failure to meet non-excludable obligations.

10. Force majeure and events beyond reasonable control

Neither party is expected to perform an obligation where performance is prevented by an event beyond reasonable control, such as severe weather, natural disaster, transport disruption, sudden illness, government restriction, civil emergency or another event that could not reasonably be avoided. The affected party should communicate the issue and its expected effect as soon as reasonably practicable.

Where such an event delays rather than prevents the service, the parties should attempt to reschedule. Where the service cannot reasonably proceed, any payment consequence is determined by the work actually performed, costs lawfully recoverable and applicable consumer rights.

11. Complaints, disputes and governing law

Questions or complaints about an assessment or service should be raised promptly with Chelmsford Master Locksmiths at [email protected] so the circumstances can be reviewed. The parties should attempt to resolve a dispute by discussing the agreed scope, records, photographs and condition of the item before considering formal proceedings.

These terms are intended to operate consistently with laws that apply to the service and the consumer. Where Australian mandatory consumer protections apply to a client, those protections are not displaced by a conflicting contractual term. Any governing-law or jurisdiction question that cannot validly be agreed is determined by the applicable law.

12. Changes to these terms

These Terms and Conditions may be updated to reflect changes in the service, operating practices or legal requirements. The version in force when a specific service arrangement is agreed should be read together with any written quotation or confirmation issued for that job.

If a provision is found to be invalid or unenforceable, the remaining provisions continue to operate to the extent permitted by law. A delay in exercising a right does not by itself waive that right.

Opening work on old locks, safes and storage is subject to inspection, condition, safe access and confirmation that the requester has authority over the property. Preservation is a working priority, but age, corrosion, previous damage and hidden construction can make some intervention unavoidable. A photo review is preliminary and does not guarantee that a particular method will be suitable on site. Any agreed service remains subject to applicable consumer rights.
